What to expect when served with divorce papers in Arizona
A default judgment may be issued against a spouse who fails to respond when served with divorce papers. The court may also rule that the petitioning spouse is entitled to attorney's fees.
Once divorce papers have been served, the responding spouse generally has 20 days to respond (30 days if out of state). If a response has not been timely received, the petitioning spouse may file for entry of default judgment. The Superior Court may rule that a defaulting spouse is obligated to pay child support and spousal maintenance. The default judgment decree cannot be entered until 64 days after the initial petition of dissolution is served upon the respondent. While this buys the respondent time, he or she must still act quickly.
